The European Social Charter : A social constitution for EuropeThe European Social Charter has been fundamentally relaunched since the mid 1990s through the adoption of the Revised European Social Charter in 1996 and the entry into force, in 1998, of the Additional Protocol providing for a system of collective complaints. The authors share the conviction that the Charter has a considerable future ahead, provided its potential is fully realized and provided, especially, the interpretation of this instrument by the European Committee on Social Rights is better understood and assimilated, and thus allowed to contribute to the building of a more social and inclusive Europe. The contributions are divided in two parts. A first part of the book offers a reading of the existing acquis. It describes both the considerable transformation of the European Social Charter since 1961, and the dynamism of the interpretation of the European Committee of Social Rights. The second part of the book, in contrast, looks forward : it examines the challenges lying ahead, and it explores the avenues the Charter could take in order to overcome current obstacles to its full implementation. A particuliar attention is given in this second series of chapters to the relationships of the European Social Charter to the law of the European Union and to the European Convention on Human Rights.
