Soil PollutionThe European Union Forum of Judges for the Environment (EUFJE) has organised its fifth yearly conference in Paris in October 2008 on a subject that is at the same time sensible, complex and essential in environmental protection : the pollution of soils.Build around the proposal for a directive of the European Commission of September 2006, this book brings together all the contributions of the conference. Besides a detailed contribution by professor Trébulle of the problems connected with the state of the soils and the functions of it, it contains presentations of the actual legal situation by specialised practitioners (Ms. Rosengardten, judge with the Swedish Environmental Court of Appeal, Mr. Clément en Ms. Fourès, advocates with the Court of Appeal of Paris), an introduction by the European Commission of the objectives of the European legislation, a description of the relevant French legislation, and all the answers provided by judges of the large majority of the Member States of the EU to a questionnaire that constituted the basis of the discussions. Tailored on the analysis of practical cases, the proceedings of the conferences are contained in a general report that highlights the essential role of judges in the effective implementation of Environmental law. In a comparative and European law perspective, this book is not only an element of general reflection, but constitutes also a supplementary tool proposed by EUFJE to all lawyers that are confronted with these questions.Established on 28 February 2004 on the initiative of senior members of the judiciary, namely Guy Canivet (France), Amedeo Postiglione (Italy), Luc Lavrysen (Belgique), the actual president, and Lord Robert Carnwath (UK), EUFJE is an international non profit organisation that is open to all judges of the European Union and the European Free Trade Association. The objective of the Forum is to promote the enforcement of national, European and international environmental law by contributing to a better knowledge by judges of environmental law, by exchanging judicial decisions and by sharing experience in the area of training in environmental law.
